TERMS AND CONDITIONS OF THE KOSMOSPOTTERY.PL ONLINE STORE

§1. General Provisions

1. The online store available at kosmospottery.pl is operated by: Kamila Malawska, ul. Kameralna 29/2, 30-376 Kraków, Tax Identification Number (NIP): 9442192009 (hereinafter referred to as: the Seller).
2. These Terms and Conditions define the rules for using the Store, placing orders, delivering goods, the Customer's right to withdraw from the agreement, and the rules for complaints.
3. The subject of sale is handmade ceramics. Due to the nature of production, individual items may vary slightly from one another in shade, shape, or dimensions (within a margin of up to 10%). These variations constitute a feature of a handcrafted product and do not represent a defect.

§2. Placing Orders

1. The Customer may place orders as a registered user or as a guest.
2. Prices listed in the Store are gross prices and do not include shipping costs.
3. An order is considered placed at the moment of clicking the button confirming the purchase and making the payment (or choosing the cash-on-delivery option).
4. After placing an order, the Customer receives an email confirming that the offer has been accepted for processing.

§3. Payments and Delivery

1. The Seller provides the following payment methods:
   • Electronic payments (e.g., BLIK, fast transfer, payment card) via a payment operator.
   • Traditional bank transfer to the Seller's bank account.
2. Delivery is carried out within the territory of Poland via:
   • InPost Parcel Lockers (Paczkomaty).
   • Courier companies.
3. Delivery costs are specified during the order process.
4. Order fulfillment time is typically 3-5 business days, unless the product description states otherwise (e.g., custom-made products).

§4. Right of Withdrawal (Returns)

1. A Consumer has the right to withdraw from the agreement without giving a reason within 14 days from the date of receiving the shipment.
2. To exercise the right to return, the Customer must inform the Seller of their decision by email: contact@kosmospottery.pl.
3. The Customer returns the goods at their own expense. Due to the fragile nature of ceramics, the Customer is obliged to carefully secure the return shipment.
4. The Seller shall refund the payment (including the cost of the cheapest available delivery method to the Customer) within 14 days of receiving the returned item.
5. Exception: The right to return does not apply to personalized products or items made to the Customer's special order according to their specifications.

§5. Complaints and Warranty

1. The Seller is obliged to deliver goods free from defects.
2. In the event of a physical defect in the goods, the Customer is entitled to file a complaint based on the statutory warranty (rękojmia) in accordance with the Polish Civil Code.
3. Complaints should be submitted to: contact@kosmospottery.pl, including a description of the defect and (optional, but recommended) photos of the damage.
4. The Seller will process the complaint within 14 days.
5. Transport Damage: It is recommended that the Customer checks the condition of the shipment in the presence of the courier or at the parcel locker. If the ceramics are found to be broken, it will facilitate the complaint process with the carrier.

§6. Personal Data Protection

The rules for processing personal data and the use of cookies can be found in the Privacy Policy available on the Store's website.

§7. Final Provisions

1. The Seller reserves the right to change these Terms and Conditions. Orders placed before the change are subject to the version of the Terms and Conditions in effect on the day of purchase.
2. In matters not regulated herein, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
3. These Terms and Conditions are effective as of April 6, 2026.
